These terms apply to all orders placed on the online shop www.elfika.eu, published by Elfika Botanics (see the legal notice). By confirming an order, the customer declares having read and accepted them.
1. The plants
We sell living plants from our own production. Photos are given for illustration only: every plant is unique, especially hybrids grown from seed. The size given is that of the last leaves.
Plants are shipped bare-root, without pot or substrate, together with their plant passport.
Some delicate species are flagged on their product page. For particularly delicate and fragile species, a confirmation is requested when adding them to the cart: the customer states having experience with similar species and accepts responsibility for growing them as soon as their bag is opened.
2. Prices
Prices are shown in euros, including VAT, excluding shipping. Shipping costs depend on the destination and the weight of the parcel and are shown before payment; delivery is free in France for orders of €100 or more. Every order comes with a gift, as described on the Delivery page.
Professionals benefit from the conditions of their account (discounts, invoicing without VAT for businesses in the European Union outside France with a valid VAT number): see the Professionals page.
3. Orders
Orders are placed from a customer account. At the Delivery step, the customer chooses the delivery method and the shipping date: the following Monday by default, another Monday, or a special request (another day, on-site pickup…) that we confirm with them before the order is completed. An order confirmation is sent by e-mail.
Forgot a plant? If the first order has not left yet, it can be completed without paying shipping twice, as explained on the Delivery page.
4. Payment
Payment is made with one of the methods offered at the Payment step. For payment by bank transfer, the order is prepared once payment is received and shipped the following Monday.
5. Shipping and delivery
We deliver to France and to the countries of the European Union. The week's orders are prepared on Sunday and shipped on Monday; they are usually delivered on Wednesday, sometimes a day later, by La Poste or UPS, with a tracking number and without signature.
Shipping may be postponed because of a public holiday, a heavy workload, a closure announced on the site or extreme temperatures along the route (below 4 °C or above 35 °C). The customer is then informed by e-mail and a new date is agreed with them. Full details are on the Delivery page.
If a delivery is late, please let us know quickly so that we can take the matter up with the carrier.
6. Receipt and claims
We guarantee plants shipped in perfect condition and carefully packed. The customer must open the parcel upon receipt. In case of a problem, the customer contacts us on the day of delivery, with photos of the plant in its bag and out of it, through the contact form, WhatsApp or Instagram. If the problem is confirmed, we offer a replacement, a credit note or a refund.
Reporting the problem on the same day allows us to see the condition of the plant on arrival: after that, it becomes impossible to tell damage caused by transport from acclimatisation difficulties.
7. After receipt
Once the plants are unpacked, growing conditions (substrate, light, humidity, temperature) depend on the customer and must suit each species. Elfika Botanics cannot be held responsible for the decline of a plant caused by unsuitable growing or acclimatisation conditions.
8. Right of withdrawal
In accordance with article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to living plants, which are goods liable to deteriorate rapidly. For any other, non-perishable items, consumers have 14 days from receipt to exercise their right of withdrawal, under the conditions provided by law.
9. Legal guarantees
Consumers benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). These terms do not limit those guarantees.
10. Professionals and Elfika creations
Purchases by professionals are subject, in addition to these terms, to the commitments made when opening their account (purchase for resale or for propagation) and, where applicable, to the propagation contract: see the Professionals page. The right of withdrawal and the guarantees specific to consumers do not apply to professional purchases.
Vegetative propagation of the hybrids and cultivars created by Elfika Botanics (Elfika hybrids, "EB" and "Elfika" cultivars) is forbidden without a prior propagation contract.
11. Personal data
Customer data is used only to process orders and for our business relationship. See our privacy policy and the legal notice.
12. Disputes
These terms are governed by French law. In case of difficulty, the customer first contacts us to find an amicable solution. Failing that, consumers may refer the matter, free of charge, to the consumer mediator named in the legal notice, or bring it before the competent court.
